ClearBrain License Terms

Last updated: 16 October 2026

These License Terms are the agreement between you and BLS Performance, LLC, a Maryland limited liability company trading as ClearBrain (“we”, “us”), for the ClearBrain software. You will be asked to agree to them at checkout and again, by clicking “I agree,” the first time the software starts. They include a software warranty (section 10), limits on our liability (section 11), and an agreement that disputes are decided in Maryland courts (section 14).

Your purchase itself is governed by the Terms of Sale.

1. What you get

We grant you a personal, non-exclusive, non-transferable license to install and use ClearBrain for your own training and that of members of your household under your supervision, on the terms below. We license the software to you. We do not sell it.

What your license unlocks — Basic or Pro — is set by the key you were issued.

2. How long it lasts

License Term
ClearBrain Basic, ClearBrain Pro Expires on the date carried in your key, which is 375 days from the date the key is issued
ClearBrain Pro Unlimited No expiry date

Keys are issued before a kit is boxed, which is why an annual key carries 375 days rather than 365 — the extra days cover fulfillment and shipping so that you still get a full year of use. We describe this as “a year” in our marketing; the date in your key governs.

We email you before your license expires, at roughly 45 days, 14 days and 1 day beforehand. Renewing is a purchase you choose to make. Nothing renews automatically and we hold no card.

What happens when an annual license expires

Training stops. Your data does not go anywhere.

When your license expires, live training is disabled. Your session history remains viewable, replayable and exportable, and your session files stay on your own computer, exactly as they were. This is a commitment, not a courtesy: we will not withhold your own training records because a license lapsed.

3. Renewals and upgrades

  • Renewal adds 365 days to your existing expiry date, so renewing early never costs you a day. If your license has already lapsed, the renewed term runs 365 days from the day you renew. Renewals are same-tier.
  • Upgrading Basic to Pro costs the difference between the two prices, and your license keeps its original expiry date. A fresh year is a renewal, not an upgrade.
  • Upgrading to Pro Unlimited costs the difference between the two prices. The new license has no expiry.
  • A license that has already expired must be renewed before it can be upgraded.

4. Your license is tied to your amplifier, not your computer

This is the part most likely to differ from what you expect, so it is worth reading.

  • Your key binds to the serial number of the first amplifier it sees. If you bought a kit, it arrives already bound to the amplifier in the box.
  • Install ClearBrain on as many computers as you like. Changing or replacing your computer costs nothing — install it, enter the same key, and carry on. There is no limit on installations and no activation count.
  • Binding only ever blocks live training. Reviewing, replaying and exporting past sessions, and the built-in demonstration recording, all work regardless.
  • If the software cannot read your amplifier’s serial number, it lets you train. We would rather an unreadable serial cost us than cost you a session.
  • Moving your license to a different amplifier. If your amplifier is replaced under warranty or you buy another one, write to us and we will move your license. One license covers one amplifier at a time.

5. Children

A child may use ClearBrain under the supervision of a parent or guardian. The license belongs to the adult who bought it. If you let a child train on your license, you accept these terms on their behalf, you confirm that you are the child’s parent or legal guardian, you agree that an adult will supervise every session, and you are responsible for their use of the software.

Nothing a child does in ClearBrain is sent to us. The software has no account, no server and no sync; a child’s sessions are files on your own computer and we never see them. We collect no information from a child through the software, because the software collects no information at all.

Before anyone trains, please read this. A small number of people have seizures triggered by flashing lights or visual patterns, sometimes with no prior history, and childhood is when that most often first appears. ClearBrain’s visual feedback dims and clears your screen gradually over several seconds — a slow fade, never a strobe, flash or flicker — but it does change the brightness of what you are looking at, continuously, for the length of a session.

Anyone who has had a seizure or loss of awareness, has epilepsy or a family history of it, or has been told they are sensitive to light should talk to a physician before training, and train only if the physician approves. Stop immediately and seek medical advice if you or your child experiences dizziness, altered vision, eye or muscle twitching, loss of awareness, disorientation, involuntary movement or convulsions. The full ClearBrain Safety Notice comes in every box and appears when the software first opens.

6. What you may not do

  • Share, resell, sublicense, rent or publish your license key, or use one key to let other people train on their own amplifiers
  • Work around, disable or tamper with the license check, the expiry date or the amplifier binding
  • Reverse engineer, decompile or disassemble the software, except to the extent that law expressly permits despite this restriction
  • Remove or alter any notice of ownership in the software
  • Use the software to provide a service to other people, or in a clinical setting as part of anyone’s treatment

Your license covers your own training and that of members of your household. It does not cover use with clients, patients or customers.

7. Ownership

The software, its design and everything in it remain ours. Nothing here transfers any ownership to you.

The software includes components supplied by third parties, used under their own terms. Those components remain the property of their owners, and their license notices are listed in the software under Help > About. Where those terms give you rights in a component, they apply to that component.

8. Your training data is yours, and it stays on your computer

ClearBrain has no server, no account and no sync. Your sessions, user profiles, settings and license are plain files in a ClearBrain folder on your own desktop. Nothing is transmitted to us and we receive no training data of any kind.

Because we hold none of it, we cannot recover it for you. Back up that folder the way you would any other work. Uninstalling or reinstalling ClearBrain does not delete it.

Please do not email us session files or session reports. We will never ask you for one, and support does not need one — a screenshot of the screen you are asking about is enough. Your recordings belong on your own computer.

9. What the software is not

ClearBrain is a general wellness product for relaxation, focus and self-regulation practice. It is not a medical device, it is not intended to diagnose, treat, cure or prevent any disease or condition, it is not a substitute for care from a licensed professional, and it is not cleared or approved by the United States Food and Drug Administration.

The amplitudes, ratios and other figures the software displays are measurements of an electrical signal. They are not a diagnosis, a score, or an assessment of your health, and no part of the software compares you against a clinical or normative database.

10. Warranty on the software

We warrant that for 90 days from purchase your license key will activate the software it was issued for, and the software will perform substantially as described on our website when used with a supported Windows computer and the ClearBrain amplifier. If it does not, email support@clearbraintraining.com during that period and we will fix the problem, send you a replacement download or key, or refund the license price (for a kit, the software portion of the price).

This warranty does not cover problems caused by unsupported computers, operating systems or Bluetooth adapters, or by other software, and we do not promise that the software will be uninterrupted or error-free. You also have implied warranties under state law, including the implied warranties of merchantability and fitness for a particular purpose. Nothing in these terms excludes or limits them, or your remedies for their breach.

Hardware is warranted separately under the Terms of Sale.

11. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to the software will not exceed the amount you paid for your license. We are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost data or loss of use, even if we have been advised of the possibility.

These limits do not apply to: (a) death or personal injury, however caused; (b) our gross negligence, willful misconduct or fraud; (c) your implied-warranty rights; or (d) any right or remedy that the law does not allow us to limit, including statutory damages, punitive damages, injunctive or declaratory relief, and attorneys’ fees available under the Maryland Consumer Protection Act or similar laws.

12. Ending the license

Your license ends if it expires and you do not renew, or if you materially breach these terms — in particular section 6 — and do not put it right within 30 days of us telling you.

If your license ends, stop using the software. Your session files remain yours and stay on your computer. We do not, and cannot, disable the software remotely.

13. Export

The software contains cryptography and is subject to United States export law. You may not use or export it in breach of that law, including to any country or person subject to United States embargo or sanctions.

14. Governing law

These terms are governed by the laws of the State of Maryland, without regard to its conflict of laws rules, except where the law of your state of residence gives you rights that cannot be waived. Any lawsuit about these terms or our products must be filed in the Circuit Court or the District Court of Maryland for Frederick County, or in the United States District Court for the District of Maryland, and you and we each consent to the jurisdiction of those courts.

15. The whole agreement, and changes

These License Terms and the Terms of Sale are the entire agreement between us about the software and supersede anything said beforehand. If any part is held unenforceable, the rest continues.

We may update these terms for new licenses and renewals. The version that applies to you is the one published when your license was issued or last renewed.
