Website Terms of Use

Last updated: 16 October 2026

1. About these terms

These Website Terms of Use govern your use of clearbraintraining.com and its content (the “Site”). The Site is operated by BLS Performance, LLC, trading as ClearBrain (“we”, “us”). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

Purchases are governed by our Terms of Sale, the ClearBrain software by our License Terms, and personal information by our Privacy Policy. Those documents control if they conflict with these terms. We may update these terms; updates apply only to your use of the Site after they are posted, and each version shows its last-updated date.

2. Who may use the Site

The Site is intended for adults in the United States. It is not directed to children under 13. Children should not use the Site, post content or contact us.

3. Our content and trademarks

The Site’s text, images, videos, software, design and other content belong to us or our licensors and are protected by copyright and other laws. You may view and print Site content for your own personal, non-commercial use. You may not copy, republish, distribute, modify or sell it without our written permission, except as the law allows. “ClearBrain” and our logos are our trademarks. Other companies’ names and marks belong to their owners.

4. Acceptable use

You agree not to use the Site in violation of any law; to impersonate anyone; to send spam; to upload harmful code or interfere with the Site’s operation or security; to access parts of the Site or its systems you are not authorized to access; or to collect information about other users by automated means without our written permission.

5. Reviews and other content you post

You are free to post honest reviews, positive or negative, and nothing in these terms limits that right. Content you post must reflect your own experience and must not include anyone’s private information or a child’s name or image, be defamatory, obscene or harassing, infringe anyone’s rights, or describe ClearBrain as treating, diagnosing or curing any medical condition. If you have a connection to ClearBrain that readers would not expect (for example, you were paid or received a free product), you must say so in your review.

You keep ownership of what you post, and you give us a non-exclusive, royalty-free license to display and share it on the Site and in our marketing, with attribution as you posted it. We will not edit a review in a way that changes its meaning, and we do not remove reviews because they are negative. We may remove content that violates these terms or the law.

6. Copyright complaints

If you believe content on the Site infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to our designated agent: Benjamin Schwinke, BLS Performance, LLC, 15 Wormans Mill Ct, Suite M, Frederick, Maryland 21701, support@clearbraintraining.com.

7. Health information

The Site’s content is general information about relaxation and focus practice. It is not medical advice and is not a substitute for care from a licensed health professional. ClearBrain is not intended to diagnose, treat, cure or prevent any disease or condition.

8. Links and availability

The Site may link to other websites, which we do not control and are not responsible for. We may change, suspend or discontinue any part of the Site, and we do not promise that it will always be available or error-free.

9. Limits on liability for use of the Site

This section applies only to your use of the Site itself, not to products you buy from us, which are covered by the Terms of Sale and License Terms. To the extent the law allows, we are not liable for indirect, incidental or consequential losses arising from your use of the Site. This does not apply to death or personal injury, our gross negligence, willful misconduct or fraud, or any right or remedy the law does not allow us to limit.

If you intentionally violate these terms, or post content that infringes someone’s rights or violates the law, you agree to reimburse us for reasonable losses and legal costs resulting from third-party claims caused by that conduct.

10. Governing law and courts

Maryland law governs these terms, except where the law of your state of residence gives you rights that cannot be waived. Any lawsuit about these terms or the Site must be filed in the Circuit Court or the District Court of Maryland for Frederick County, or in the United States District Court for the District of Maryland, and you and we each consent to the jurisdiction of those courts.

11. General and contact

If a court finds part of these terms unenforceable, the rest stays in effect. If we don’t enforce a term, that is not a waiver. Contact: BLS Performance, LLC · 15 Wormans Mill Ct, Suite M, Frederick, Maryland 21701 · support@clearbraintraining.com
