Terms of service
Last updated: 16 October 2026
These Terms of Sale govern your purchase of ClearBrain products from clearbraintraining.com. The seller is BLS Performance, LLC, a Maryland limited liability company trading as ClearBrain (“we”, “us”). Before you place an order, you will be asked to check a box confirming that you agree to these terms. Please read them, in particular our Limited Warranty (section 8), the limits on our liability (section 10), and our agreement that disputes are decided in Maryland courts (section 11).
Your use of the ClearBrain software is governed separately by the ClearBrain License Terms, which you accept at checkout and again the first time the software starts. Use of this website is governed by our Website Terms of Use, and our Privacy Policy explains how we handle personal information.
1. Who we sell to
We sell to customers in the United States only, and we ship only to United States addresses. We do not currently sell or ship internationally.
You must be at least 18 years old, or the age of legal majority where you live if that is older, to buy from us. A ClearBrain license may be used by a minor under the supervision of a parent or guardian, but the purchase, the license and the obligations under these terms belong to the adult who bought it.
2. Children
ClearBrain is bought by adults. It may be used by a child under the supervision of a parent or guardian. If you buy ClearBrain for a child, you are the customer: the purchase, the license and everything in these terms are yours, and you accept the License Terms on that child’s behalf. You confirm that you are the child’s parent or legal guardian and that an adult will supervise every session.
This website is not directed to children. We do not knowingly collect personal information from anyone under 13, and a child should not enter an email address or any other detail on this site. If you believe a child has given us information, write to support@clearbraintraining.com and we will delete it.
Before anyone trains — please read this
A small number of people have seizures triggered by flashing lights or visual patterns, sometimes with no prior history, and childhood is when that most often first appears. ClearBrain’s visual feedback dims and clears your screen gradually over several seconds. It is a slow fade, never a strobe, flash or flicker. What it does do is change the brightness of what you are looking at, continuously, for the length of a session.
Anyone who has had a seizure or loss of awareness, has epilepsy or a family history of it, or has been told they are sensitive to light should talk to a physician before training, and train only if the physician approves. Stop immediately and seek medical advice if you or your child experiences dizziness, altered vision, eye or muscle twitching, loss of awareness, disorientation, involuntary movement or convulsions. The full ClearBrain Safety Notice comes in every box and appears when the software first opens.
3. Products and prices
We sell software licenses, kits that combine a license with hardware, and replacement parts.
| Product | Price | What it is |
|---|---|---|
| ClearBrain Basic | $149 | Software license, one year |
| ClearBrain Pro | $299 | Software license, one year |
| ClearBrain Pro Unlimited | $549 | Software license, no expiry |
| ClearBrain Basic Kit | $599 | Basic license plus hardware |
| ClearBrain Pro Kit | $749 | Pro license plus hardware |
| ClearBrain Pro Unlimited Kit | $999 | Pro Unlimited license plus hardware |
| Replacement Cable | $85 | Spare magnetic electrode cable |
Prices are in US dollars and are introductory launch prices. We may change prices at any time. A change never affects an order already placed. Prices do not include tax or shipping, which are shown at checkout before you pay.
Each kit contains the amplifier, the magnetic electrode cable, a ClearBrain hat and a tube of skin-prep gel, matched and tested before shipping. The amplifier and its cable are made by a third-party manufacturer and arrive carrying that manufacturer’s branding. We warrant them ourselves under section 8.
4. Orders
Your order is an offer to buy. The automatic email we send when you place an order confirms that we received it; it is not our acceptance. We accept your order when we ship the goods or, for a software-only order, when we email your license key. We may decline an order, or cancel it before shipping and refund you in full within 5 business days, for any lawful reason — including a pricing or description error on the site, stock we cannot supply, or an order we believe is not for a genuine end user.
If a price is shown in error we will tell you before shipping and you may confirm the order at the correct price or cancel it for a full refund.
5. Payment and tax
We take payment through Shopify’s secure checkout, using the payment methods shown there. Payment is taken in full at the time of purchase. We do not store your card details and we never place a card on file.
Nothing we sell renews automatically. Licenses carry an end date. We email you before that date, and renewing is a separate purchase you choose to make. We will not charge you again without a new order.
Prices do not include sales or use tax. We collect tax where the law requires, based on your shipping address, and show it at checkout before you pay.
6. Shipping and risk
Orders that include hardware normally ship within about one week. Delivery estimates are estimates, not guarantees. If we cannot ship within the time stated at checkout, or within 30 days if no time is stated, we will email you before that date with a new estimate and the option to cancel for a full refund.
Risk of loss and damage passes to you on delivery to the address you gave us. If a parcel arrives damaged, please tell us within 7 days of delivery and keep the packaging, so we can make a claim against the carrier. We will replace or refund anything that arrives damaged. Telling us later does not affect your rights under the Limited Warranty or the law.
Software-only orders ship no physical goods; your license key is emailed to you.
7. Returns — changing your mind
Hardware: 30 days
Return hardware within 30 days of delivery, in resellable condition and with everything that came in the box, and we refund the purchase price less the original shipping cost. Return postage is yours to pay. Write to us first so we can tell you where to send it.
Software: 14 days
We refund a software license within 14 days of purchase. A refunded license is void from the date of the refund. ClearBrain runs entirely offline, so we cannot disable a key remotely; continuing to use a refunded license is use without a license.
Kits: a kit returned within 30 days of delivery is refunded in full, less the original shipping cost — hardware and license together. The license that came with it is void from the date of the refund.
These return rights are separate from the warranty below. Returns care about condition. Warranties care about defects.
Damaged, defective or wrong items are not a change of mind. If something arrives damaged or defective, or is not what you ordered, tell us and we will pay the return shipping and replace it or refund it in full, including the original shipping. A defect that appears later is covered by the Limited Warranty in section 8.
8. Limited warranty
LIMITED WARRANTY. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
Who gives it and who is covered. BLS Performance, LLC warrants to the original purchaser, and to anyone who later owns the hardware during the warranty period and has a copy of the original receipt, that the hardware will be free from defects in materials and workmanship, in normal use, for the periods below, measured from the date the original purchaser received it:
| Part | Period from delivery |
|---|---|
| Amplifier | 12 months |
| Magnetic electrode cable | 60 days |
| Hat and skin-prep gel | Not covered — consumable items (but we will replace any that arrive defective) |
What we will do. If a covered part fails in that period, we will replace it free of charge, including shipping both ways. If we cannot replace it, we will refund what you paid for it. That is your remedy under this written warranty; it does not limit your implied-warranty rights described below. A replacement part is covered for the remainder of the original period or 90 days, whichever is longer.
How to make a claim. During the warranty period, email support@clearbraintraining.com or write to BLS Performance, LLC, 15 Wormans Mill Ct, Suite M, Frederick, Maryland 21701. Include your order number (or a copy of your receipt), the amplifier’s serial number, and a short description of the problem. We will try to solve it with you first. If the part needs replacing, we will send the replacement and a prepaid label to return the failed part, normally within 5 business days.
What this warranty does not cover
- Damage from dropping, liquid, or misuse, including gel or moisture in the charging port
- Normal wear. The cable is a wear part — that is what the 60 days measures. Fraying or a connector worn loose over months of handling is wear, not a defect
- Battery capacity lost to storage at low charge. Lithium cells degrade when left flat, so top the amplifier up every month or two if you are not training. A cell that fails despite normal use and charging is covered.
- Damage caused by opening, modifying or attempting to repair the amplifier. The amplifier is sealed and has no user-serviceable parts, and opening it will almost always damage it. Using a third-party charger or accessory does not by itself void this warranty, but damage it causes is not covered.
Your implied warranties
You also have implied warranties under state law, including the implied warranties of merchantability and fitness for a particular purpose. This warranty does not exclude or limit them, how long they last, or your remedies for their breach.
9. What ClearBrain is not
ClearBrain is a general wellness product. It is not a medical device. It is not intended to diagnose, treat, cure or prevent any disease or condition, it is not a substitute for care from a licensed professional, and it is not cleared or approved by the United States Food and Drug Administration.
We cannot give clinical advice, interpret your data, or tell you what a reading means for your health.
10. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or relating to any product, whether in contract, tort or otherwise, will not exceed the amount you paid us for that product. We are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost data or loss of use, even if we have been advised of the possibility.
These limits do not apply to: (a) death or personal injury, however caused; (b) our gross negligence, willful misconduct or fraud; (c) your implied-warranty rights; or (d) any right or remedy that the law does not allow us to limit, including statutory damages, punitive damages, injunctive or declaratory relief, and attorneys’ fees available under the Maryland Consumer Protection Act or similar laws.
11. Governing law
These terms are governed by the laws of the State of Maryland, without regard to its conflict of laws rules, except where the law of your state of residence gives you rights that cannot be waived. Any lawsuit about these terms or our products must be filed in the Circuit Court or the District Court of Maryland for Frederick County, or in the United States District Court for the District of Maryland, and you and we each consent to the jurisdiction of those courts.
12. Changes to these terms
We may update these terms. The version in force for your order is the one published when you placed it; changes apply only to later orders. Each version shows its last-updated date, and we will keep superseded versions available on request.
